1. Who we are and what these terms cover
These Terms of use govern access to and use of the website craftedpixel.rs and its related subpages (the “Site”). The Site is run by CraftedPixel, a design and engineering studio based in Novi Sad, Republic of Serbia (“CraftedPixel”, “we” or “the studio”). Contact: office@getcraftedpixel.com, +381 65 43 63 142 (WhatsApp / Viber). Founder: Marko Banović, marko.banovic@craftedpixel.rs.
The English version of the Site is at craftedpixel.rs/en/, and these terms apply to both versions. If there is a separate written contract with a client, that contract takes precedence in case of conflict.
The Privacy policy and the Cookie policy are an integral part of these terms.
2. Acceptance
By accessing the Site, you confirm that you have read and accept these terms. If you don’t agree, don’t use the Site. The Site is intended for business users (companies, sole proprietors and people acting on behalf of a company). It is not intended for children under 16.
3. Browsing is not a service agreement
Site content (service descriptions, packages, prices, case studies, blog and the like) is for information. Browsing, sending an inquiry or downloading materials from the Site does not create a client, agency, employment or partnership relationship.
A binding engagement begins only with a written contract, statement of work (SOW), confirmed proposal or another document accepted by both parties. Until then, proposals, estimates and timelines are indicative.
4. Services we offer
The studio does UI/UX design, web development, WordPress, SEO and growth, brand systems, content and CMS, 3D and rendering, AI and automation, analytics, website maintenance and related work. Details are on the service pages and on pricing.
On the Site we also present our own products and promotions, for example:
- PropertyDesk - a product in development; its public address is propertydesk.app. Use of that product is governed by its own terms once they are published, not only by this page.
- Free website promotion - a limited promotion with its own application rules, number of spots and deadlines listed on that page.
5. Proposals, pricing and payment
Prices on the Site are indicative and may differ from the final proposal (scope, timeline, third parties, VAT). The final price, currency (EUR or RSD), deposit, schedule and payment method are set out in the proposal or contract.
In practice, for most projects we ask for a deposit before work starts; the rest is paid in agreed milestones or at handover. Until the deposit is received, we are not obliged to start. Late payment may pause work or the handover of materials.
Cancellation, rescheduling and the cost of work already done are governed by the contract. If the contract is silent, we charge for work actually done and third-party costs we have already incurred with your consent.
6. Acceptable use of the Site
You agree not to use the Site unlawfully and not to:
- attempt unauthorized access, vulnerability scanning or disruption of the Site;
- bulk-download content with bots, scrapers or similar tools, except public search engines in normal SEO indexing;
- send spam, malicious code or false data through the forms;
- use our materials, logo or name in a way that suggests you are us or that we endorse you, without consent.
We may restrict access temporarily or permanently if we reasonably believe there is misuse.
7. Intellectual property of the Site
The Site’s design, text, graphics, logo, photos, code and other materials, unless stated otherwise, belong to CraftedPixel or its licensors and are protected by copyright and related rights. You may view and print a reasonable portion for personal, non-commercial use. Copying, adapting, reselling or creating derivative works without written consent is not allowed, except to the extent the law expressly permits.
Client names, brands and images in case studies remain the property of those parties. We use them with consent or to the extent that is customary for showing publicly released work.
8. Client work: handover and rights
Rights to deliverables (website, design, code, brand materials) are governed by the client contract, not these terms. If the contract is silent, once the agreed price is paid in full, the client gets the right to use the delivered materials for the agreed purpose. Until then, we retain all rights.
Tools, libraries, frameworks, plugins and open-source components remain under their own licenses. We do not transfer the studio’s templates, internal libraries or know-how unless this is expressly agreed.
The client guarantees that the materials it hands over to us (text, photos, logo, databases, access credentials) do not infringe third-party rights and that it has the right to give them to us for processing. If a claim arises because of such material, the client bears the cost of defense and any damages, unless the cause is our intent or gross negligence.
9. Portfolio
We reserve the right to publicly show completed work (name, visual, short description, link) in our portfolio, on the Site and on social media, unless otherwise agreed in a written contract or NDA. If a project must stay confidential, tell us before work starts.
10. Confidentiality
We treat business information exchanged in an inquiry or project as confidential and don’t share it with third parties without need, except with subcontractors under the same obligation, or where the law requires it. We sign a formal NDA when the client asks for one or when the nature of the work calls for it.
Don’t treat messages sent through the public forms on the Site as a place for secrets (passwords, access tokens, health or financial records). For those, we use an agreed secure channel after signing.
11. Materials and deadlines on your side
The timelines we give apply if we receive the brief, access, copy, decisions and feedback on time. Waiting on the client extends the timeline proportionally, and that alone does not count as a delay on our part.
12. Third-party links and services
The Site may link to third-party services or use them in the background (hosting, CDN, forms, analytics, WhatsApp, social media). Those services have their own terms. We are not responsible for their content, availability or privacy policies. Including a link is not an endorsement.
13. Site availability
The Site is provided “as is” and “as available”. We work to keep it running, but we don’t guarantee uninterrupted operation, freedom from errors, or that every browser or device will display everything the same way. Scheduled maintenance and third-party outages (hosting, DNS, CDN) may temporarily interrupt access.
14. Liability
For use of the Site itself (reading, sending inquiries), we are not liable for indirect damage, lost profit, or loss of data or reputation, unless the damage was caused by our intent or gross negligence, or the law does not permit such a limitation.
Liability for paid client work is governed by the contract. If the contract is silent, our total liability for that engagement is limited to the amount the client actually paid for the disputed service, except in cases the law does not allow to be limited (intent, gross negligence, liability for bodily injury).
We are not liable for decisions you make based solely on the general content of the Site (budget, timeline or technology estimates) without a signed proposal.
15. Changes
We may update these terms. When we do, we change the date at the top. Continuing to use the Site after publication means you accept the new version. Existing client contracts are governed by the text in effect at the time of signing, unless we agree otherwise in writing.
16. Governing law and jurisdiction
These terms and the use of the Site are governed by the law of the Republic of Serbia, without regard to conflict-of-laws rules. Disputes arising from these terms or the use of the Site fall under the competent court in Novi Sad, unless a mandatory regulation requires different jurisdiction.
A separate client contract may specify a different forum or governing law. That provision then applies only to that contract.
